TERMS OF SERVICE
Welcome to Pup Festival, events for dogs and their people. By attending, accessing or using our website (pupfestival.com), parties, pop ups, events, facilities, or services, you agree to comply with the following Terms of Service. Please read these terms carefully.
1. Use of Our Services Pup Festival hosts events for dogs and their people. Use of our services is subject to these Terms, any applicable laws, and our posted rules and policies.
2. Eligibility To attend our events, dogs must be current on vaccinations and demonstrate appropriate social behavior. All users must be at least 18 years old to attend unless accompanied by an adult.
3. Attending Event(s) By attending a Pup Festival event, you agree to abide by posted safety rules and accept full responsibility for your dog’s behavior.
4. Liability Waiver By entering and attending our Pup Festival events, you accept that dog play is inherently unpredictable. Pup Festival is not responsible for injuries to dogs or humans caused by other patrons, animals, or the venue itself. You agree to hold Pup Festival LLC and its affiliates harmless from any resulting claims.
5. Conduct and Safety Aggressive dogs or disruptive behavior by owners may result in removal or banning. Alcohol is served responsibly in designated areas at select Pup Festival events. Children must be supervised at all times. We reserve the right to refuse service to anyone for any reason.
6. Intellectual Property All content on this website and at our events—including logos, photos, designs, and written material—is the property of Pup Festival and may not be reused without permission.
7. Changes to Terms We may update these Terms of Service periodically. Continued use of our services indicates acceptance of the revised terms.
Pet Owner Liability & Indemnification
The venue and the event producer (collectively, the "Indemnified Parties") shall not be liable for any injury, loss, or damage to persons or property arising out of or in connection with any pet-related incident that occurs at Pup Festival (the "Event").
By attending the Pup Festival event, the attendee (the "Indemnifying Party") hereby agrees to indemnify and hold the Indemnified Parties harmless from and against any and all claims, demands, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with any pet-related incident that occurs at the Event.
The Indemnifying Party further agrees that the Indemnified Parties shall not be liable for any injury, loss, or damage to persons or property arising out of or in connection with the negligence of the Indemnified Parties, their agents, or employees.
Aggressive Breeds & Leash Policy
Pup Festival is a highly inclusive, pet-friendly event by design. However, safety of our attendees and their pets is of paramount importance. Therefore, the event producer reserves the right to refuse entry to any dog that it deems to be aggressive - either by breed, behavior or if not leashed.
The event producer reserves the right to make the final determination of whether or not a dog is permitted at the festival.
1. Acceptance of Terms
By accessing or using the Pup Festival LLC website (the “Site”) and any associated services, features, content, or applications (collectively, the “Services”), you agree to comply with and be bound by these Terms and Conditions (“Terms”). If you do not agree with any part of these Terms, you must discontinue use of the Services immediately.
2. Definitions
• “Company” “we,” “us,” or “our” refers to Pup Festival LLC its affiliates, officers, directors, employees, and agents.
• “User,” “you,” or “your” refers to any individual or entity accessing or using the Services.
• “Content” means any text, images, graphics, videos, audio, software, or other materials displayed, transmitted, or made available through the Services.
3. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to access or use the Services. By using the Services, you represent and warrant that you meet this requirement and possess the legal right and capacity to enter into these Terms.
4. User Account and Security
1. Account Registration: Some features of the Services may require registration. You agree to provide accurate, current, and complete information and to update such information promptly.
2. Account Security: You are responsible for safeguarding your account credentials and for all activities under your account. You must notify us immediately of any unauthorized use.
5. Use of the Services
5.1 Permitted Use
• Access and use the Services solely for personal, non-commercial purposes, unless otherwise authorized in writing.
• Comply with all applicable laws, regulations, and these Terms.
5.2 Prohibited Conduct
You agree not to:

• Use automated systems or software to extract data or otherwise interact with the Services.
• Engage in any activity that disrupts, degrades, or impairs the Services.

6. Donations and Payments
1. Donations: All donations are voluntary, non-refundable, and final, unless otherwise required by law or at our sole discretion.
2. Payment Processing: Transactions are processed by secure, PCI-compliant third-party processors. You agree to their terms of service and privacy policies.
3. Tax Receipts: Donation receipts will be issued in accordance with applicable tax laws. It is your responsibility to retain records for tax purposes.
7. Intellectual Property
1. Ownership: All Content and trademarks on the Services are owned by Pup Festival LLC or its licensors.
2. Limited License: Subject to these Terms, you are granted a limited, revocable, non-exclusive, non-transferable license to access and use the Services.
8. User-Generated Content
1. Submission: By submitting any content (including comments, photos, testimonials), you grant the Foundation a perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, modify, publish, and distribute such content in any media.
2. Responsibility: You represent and warrant that you own or have rights to all submitted content and that it does not violate any law or third-party rights.
9. Privacy
Your privacy is important to us. Our collection and use of personal information are governed by our Privacy Policy, which is incorporated by reference into these Terms.
10. Disclaimers
1. No Warranty: The Services are provided “as is” and “as available,” without any warranty of any kind, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
2. Information Accuracy: We do not guarantee the accuracy, completeness, or reliability of any Content provided through the Services.
11. Limitation of Liability
To the fullest extent permitted by law, the Foundation and its affiliates, officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or related to your use of or inability to use the Services, even if advised of the possibility of such damages.
12. Indemnification
You agree to defend, indemnify, and hold harmless Pup Festival LLC and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising from or in any way connected with your access to or use of the Services or violation of these Terms.

The Services may contain links to third-party websites, services, or resources. We are not responsible for their content, accuracy, or practices. Your interactions with third parties are solely between you and that third party.

16. Governing Law and Dispute Resolution
1. Governing Law: These Terms are governed by the laws of the State of Arizona, without regard to conflict of laws principles.
2. Dispute Resolution: Any dispute arising under these Terms will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, to be held in Phoenix, Arizona, unless otherwise agreed.
17. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.
18. Waiver
Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
19. Entire Agreement
These Terms, together with the Privacy Policy and any other legal notices published by us on the Services, constitute the entire agreement between you and the company Pup Festival LLC regarding your use of the Services.
